A former Oregon politician, Don Gomez, won a lawsuit against Newport radio stations KSHL and The WAVE for failing to air his political ads during his primary campaign for Lincoln County commissioner. Gomez paid $450 for ads scheduled to run from May 7-21 but claimed they were never broadcast, negatively affecting his campaign, where he finished fourth out of five candidates. Gomez and his wife monitored the stations and found no evidence the ads aired. Additionally, he accused KSHL of neglecting to file required FCC reports. KSHL co-owner Leslie Brown denied the allegations. Circuit Court Judge Sheryl Bachart ruled in Gomez’s favor, awarding him $3,615 in damages plus legal fees. After KSHL’s owners avoided legal service for months, the judge imposed a judgment lien on the property of Brown and co-owner Stephanie Linn. This ruling highlights the accountability of broadcasters in fulfilling contractual obligations for political advertising.
